DBS

Post by Eyres_11 » Tue Nov 09, 2021 3:04 pm

Just after a bit of advice really.

Would a recent (last 3 weeks) arrest show on an enhanced DBS submitted say today, even if the offence isn't specified (Ie. Sex crime)? So was more of a minor crime, something that would carry probably a maximum of conditional discharge if charged.

No charges, literally an arrest and released on investigation?

I have tried Google but looking for actual experiences or knowledge kind of thing.

I'm not sure how quickly an arrest would show but unless the information held on a DBS has changed recently it will show, even if there was no charge.

I bloke I worked with was arrested on child porn offences. I can't remember the details and I'm not tech savvy but it was something about tracing an IP address to his flat but had happened before he had moved in so was clearly not him. Still went on his DBS though.

Yeah , that would come under a specified offence, im not sure anything minor would?

Like I said, things may have changed as I've not been in a role where DBS checks are required for about four years now but in the past minor offences were on there.

Have a read of this - from a quick scan it looks like it may answer your question

Thanks

It was this bit

"local police records that is reasonably considered relevant to the job in question"

that I was unsure about, surely an arrest is just that, anyone could be arrested for anything and if no charges or cautions I fail to see how it is relevant, I could make an accusation against anyone at anytime.

I have just applied for a new role and they have stated that even if something shows up on the DBS (not that there is anything...I know of!!) then it would not automatically preclude me from the role......

Seems a bit strange that the cops would arrest someone by tracing it to an IP address. Cant you get a VPN which just hides/uses someone else's IP address?

I dont fully understand VPN. Im told on various podcasts they are worth getting for security but i have never bothered because im boring and have nothing to hide/to steal/ interesting going on

Surely it is only proven charges that show up on a dbs.

I honestly don't know. As I said I couldn't remember the exact details, especially the tech aspect but they were able to establish the dates and times and it was before he had moved in. I worked at a different office some of the time so wasn't there but he was arrested at work. High drama by all accounts.

Update on this - with DBS at stage 4 (local police checks) I was contacted by the police and told no further action apart from a fixed penalty notice - now I have seen the police COULD put this on but as it is only for causing some disorder does anyone have any experience as to if they would disclose this on an enhanced one? TIA

Seems strange the police proactively contacted you...my Enhanced DBS was conducted recently and although I had no worries about it, it would seem strange that this would happen.....however, if it is just a fixed penalty I can't see it being shown....

Yeah, they just called me to say no assault actually happened and were just issuing a ticket.

Only worry I have is if they did the check BEFORE issuing the ticket whilst I was technically still a suspect.
