There’s nothing immediately wrong with the taser being energised for 33 seconds. Of course, it will have to be explained, but it depends how the taser has been deployed, the subjects response to being tasered and how that 33 seconds is broken down.
First of all, there is the red dot challenge. 90% of red dot challenges have the desired effect, and the subject surrenders.
So, the 10% of the time, is when the subject hasn’t obeyed instruction or the officer doesn’t feel there is sufficient time to give a red dot challenge as the subject is coming at them, or members of the public.
If a subject is tasered, the cycle lasts for 5 seconds. You then give aftercare. The next step is to get the subject into a position of control. So ideally on their knees or front, hands on head ready for handcuffing.
If a subject continues to disobey instruction and either keeps going for a knife or offering violence, then the taser can be re-energised at any point. There is a button on the side of the taser that can be pressed to re-energise the taser. How long is down to the officers discretion.
If a subject is plainly not obeying, and continuing to offer violence, then the officer will shout ‘detention under power’, and the officers with him will know that they need to get in there, get handcuffs on, whilst the subject is being tasered, so long as they don’t put their hands between the probes.
So it’s conceivable that someone can be tasered for a total of 33 seconds, broken down into parts.
I don’t know enough about the case to know how Atkinson was acting, and I’m not insinuating he was disobeying, but for a taser to be discharged in the first incident would suggest there is an element of not complying with instruction and still posing a risk. This can obviously be because someone is unwell, and not understanding instruction, but ultimately, that person still needs to be controlled.
Atkinson being kicked in the head will certainly require an explanation. You just don’t do it. And you are never trained to do so.
