I think in this case it will be reputational damage that will be incredibly hard to prove. that is incorrect. The crown need to prove you were the driver of the vehicle. you do not have to prove anything. however, since driving offences are strict liability offences if they can prove you were driving they don't then have to prove your mental state.
There must be some sort of limitations on that, though. Agree 100%, however if Mrs Vardy issues proceedings Mrs Rooney simply had to defend the action if she felt she was innocent. I haven’t read the judgment but I imagine Mrs Vardy will be able to appeal, although I would hope her lawyers have advised her against it, if the advice is the opposite then Mr & Mrs Vardy had better think seriously about what it might end up costing them.

She does indeed and Ms Vardy will be liable for them. I'd always anticipated that the judge would find in favour of Ms Vardy, but award only £1 or perhaps ten, leaving the door open for Mrs Rooney to make a costs claim based on her previous counter-bank settlement offers; she must have really ****** off the Judge to lose completely.
